If you have recently bought an SUV and you believe it to be a lemon, there is good news amongst all the bad news you are facing. SUV lemon laws exist on the books in most states to protect you in such a situation. Knowing your rights is of the utmost importance when trying to get a replacement SUV or a refund on your SUV purchase. Under SUV lemon laws, a dealer MUST accept the return of your SUV and offer a refund if they are unable to repair the problem which impairs the use of your SUV in a reasonable amount of time. But what is a reasonable amount of time? The dealer must be given a reasonable chance to fix the SUV’s issue during the lemon law warranty period. But, if the same problem has been the cause of a repair three times or more (And the problem still exists afterwards) a reasonable time period has expired. Also, if the SUV is in a repair shop for 15 days or more, the “reasonable period” has long expired.
Many often wonder if they can still receive a refund on their SUV or a replacement SUV even if the problem has eventually been repaired. The truth is you do have the rights to a refund or a replacement if the SUV’s problem is fixed, as long as it took over the “reasonable time period” to fix the problem. Just because a dealer fixes your problem does not mean that they do not owe you a refund. They can not expect you to spend weeks without your car and act like everything is fine once they finally fix the problem. If a problem takes 15 days to fix (Not counting days it may take to find a part and get it delivered) then that SUV is not worth keeping and you deserve a refund or a replacement.
Any SUV you buy should come with a SUV lemon law warranty. All dealers must give you a copy of a lemon law warranty at the time of your purchase or lease. The SUV lemon law warranty may be included in the sales contract or lease. It could also be given to you on a separate sheet of paper. If does appear to be part of the sales contract or lease, be sure that it is separated from the other contract provisions and headed by a conspicuous title so as to not appear hidden. Even if a dealer doesn’t give you a lemon law warranty on paper, the law assumes they did and you are covered by SUV lemon laws regardless.
